These Terms & Conditions (“Terms”) are an agreement between you and COPPSARY, operating the Motify product and service (“Motify,” “we,” “us,” or “our”). By creating an account, accessing Motify, or purchasing a subscription, you agree to these Terms and our Privacy Policy and Refund Policy.
1. About Motify
Motify is an AI-assisted, web-native motion graphics service for creating and editing product videos, explainers, launch content, and related assets. Features, generation limits, model availability, and output quality may evolve as the service improves.
2. Eligibility and accounts
You must be legally capable of entering into a binding contract in your country. If you use Motify for an organization, you confirm that you are authorized to bind that organization to these Terms. You are responsible for accurate account details, protecting your credentials, and all activity under your account. Notify support@motify.video promptly if you suspect unauthorized use.
3. Plans, credits, and service limits
Paid plans provide the credits and features shown on our Pricing page or at checkout. Video counts are estimates; actual credit use may vary with project length, complexity, selected model, and output settings. Credits are service units, not money, and cannot be transferred, resold, or redeemed for cash. We may apply reasonable technical and usage limits to protect the service and other customers.
4. Billing and Paddle
Prices, billing frequency, applicable taxes, and the total charge are shown before you complete a purchase. Paid monthly subscriptions automatically renew each month until canceled. You authorize Paddle to charge the payment method associated with your purchase for each renewal. Paddle’s Buyer Terms also apply to purchases processed by Paddle.
5. Cancellation
You may cancel at any time through the Paddle Customer Portal linked in your purchase or renewal email, or through Paddle buyer support. Cancellation takes effect at the end of the current billing period. You retain access until then and will not be charged for another renewal. Cancellation does not automatically create a refund; refund eligibility is explained in our Refund Policy.
6. Your content and AI-generated output
You retain any rights you hold in prompts, uploads, brand materials, and other content you submit. You grant us a limited license to host, process, reproduce, and transform that content only as needed to operate, secure, support, and improve the service. You are responsible for ensuring that you have permission to use submitted content and for reviewing output before publishing it.
AI output may be inaccurate, incomplete, similar to output generated for others, or unsuitable for a particular purpose. We do not guarantee that output is unique or free of third-party rights. You are responsible for legal, factual, and brand review of your final work.
7. Acceptable use
You must not use Motify to:
- break the law, violate another person’s rights, or create deceptive or fraudulent content;
- upload malware, bypass security, probe vulnerabilities, or disrupt the service;
- generate abusive, exploitative, hateful, or sexually explicit content involving minors;
- impersonate others or misrepresent AI-generated material in a harmful way;
- resell access, scrape the service, or reverse engineer non-open-source portions except where law permits; or
- use automated means that create unreasonable load or evade plan and credit limits.
8. Motify intellectual property
Motify, its hosted service, branding, interface, and proprietary materials are owned by or licensed to COPPSARY. These Terms do not transfer those rights to you. Any separately released open-source software remains governed by its applicable open-source license.
9. Third-party services
Motify may connect to third-party services, AI providers, authentication providers, hosting platforms, integrations, or websites. Their own terms and privacy policies govern their services. We are not responsible for third-party services outside our control.
10. Availability, changes, and termination
We work to keep Motify available but do not promise uninterrupted or error-free operation. We may update, suspend, or discontinue features, or restrict access when reasonably necessary for maintenance, security, legal compliance, non-payment, or a material breach of these Terms. Where practical, we will give reasonable notice of material changes that adversely affect paid use.
11. Disclaimers
To the extent permitted by law, Motify is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. Nothing in these Terms limits a warranty or consumer right that cannot legally be excluded.
12. Limitation of liability
To the extent permitted by law, COPPSARY and its team will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, goodwill, or business opportunities. Our total liability arising from Motify will not exceed the amount you paid for the service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot be limited by law.
13. Governing law and disputes
These Terms are governed by the laws of Cambodia, without regard to conflict-of-law rules, except where mandatory consumer law gives you additional rights. Before filing a formal claim, please contact hello@motify.video so we can try to resolve the issue informally.
14. Changes and contact
We may update these Terms as the service or law changes. We will post the revised version and update the date above. If a change materially affects your rights, we will provide additional notice where required. Questions about these Terms may be sent to hello@motify.video.
